Iowa enforces laws that regulate the building of fences.
Homeowners in Iowa build fences for privacy and protection. Iowa is unique in that the state requires all property owners to build a partition fence if requested by an adjoining landowner. Regardless of the purpose of the fence, laws regarding where the fence is built must be followed.
Location
According to Iowa statute, "A fence must be built on the property line between adjacent tracts of land." While it is not obligatory for a property owner without livestock to install fencing automatically, homeowners have the right to request an agreement for a fencing proposal from individuals who own adjoining property.
Required
Farmers are required to build and maintain fences around livestock. If a farmer neglects to fence in livestock and animals under her care, she is liable for any damage an animal makes while trespassing on another person's land or public road.
Requested
An adjacent landowner has the right to request that his neighbors agree to a fencing proposal. If the adjacent neighbor requests a fence to be built between adjoining properties, he must first write a letter to his neighbor requesting fencing. If this fails to work, he can petition the local municipality, which will then give at least five days notice to all adjoining landowners that they are liable for the erection and maintenance of a partition fence.
